On October 7, the first lawsuit in connection with the chicken salad recall was filed by the national food safety law firm Pritzker Hageman on behalf of a Nebraska man who was hospitalized with a serious Listeria infection after eating chicken salad that was purchased from a Sam’s Club store.
Health officials in the U.S. and Canada have been investigating parallel Listeria outbreaks for months. Canadian health officials have linked the outbreak to cooked chicken products produced by Rosemount Foods. During their investigation, they collected and tested multiple cooked chicken products and found that a number of samples produced by Tip Top tested positive for Listeria.
Genetic tests showed that patients in Canada were all sickened by the same Listeria strain and that the strain closely resembles the Listeria strain associated with the ongoing Listeria outbreak in the United States which has sickened 24 people, killing two of them. But, in the U.S., health officials have been slow to provide information on the outbreak and which company/companies or products may be responsible. The Centers for Disease Control and Prevention (CDC) last updated its information on the outbreak on August 23.
Symptoms of a Listeria infection include high fever, severe headache, muscle aches, abdominal pain, nausea and diarrhea. Among pregnant women, Listeria can cause miscarriage and stillbirth.
In addition to filing the first lawsuit in connection with this recall, Pritzker Hageman has secured the largest-ever settlement for a U.S. person sickened by Listeria.
