The food safety lawyers at Pritzker Hageman filed the first Listeria lawsuit in connection to the cooked chicken recall. The Defendants named in the suit include Tip Top Poultry Inc., E.A. Sween Company, The Suter Company, Inc., and Sam’s West (DBA Sam’s Club). Our client, Mr. Craig Moraski of Bellevue, NE, became sick with listeriosis after eating chicken salad that came from Tip Top, E.A. Sween, Suter, and Sam’s.

Mr. Moraski’s wife purchased 2-lb. tubs of “Member’s Mark Chicken Salad” from a Sam’s Club store in Papillion, NE. Soon after, she received an email that the product was part of a major Listeria recall issued by Tip Top Poultry. Tip Top is an ingredient supplier to The Suter Company, which supplies chicken salad products to E.A. Sween, which then processes and sells the products to retail stores, including Sam’s Club. Mr. Moraski experienced Listeria symptoms that same evening. He was hospitalized after testing positive for a Listeria infection.
